The trademark registration office in Nigeria is a place where a trademark agent or lawyer can be contracted for a trademark filing. A Trademark is a recognizable word or words, signs or expressions registered in the Trademark registry to represent or identify a company, products or services to distinguish its brand from others. Accredited agents appointed with a Power of Attorney for the Applicant file a Trademark at the Trademark Registry Abuja.

A trademark to be accepted by the registry for filing must contain at least one of the following as provided under Section 9 of the Trade Mark Act:

  • A name of a company, individual or firm represented in a particular or special manner
  • The signature of the applicant for registration
  • An invented word or words
  • A word or words having no direct reference to the character or quality of goods not being in its ordinary specification a geographical name or surname
  • Any other distinctive mark.

Filing a trademark application in the Trademark, Patents and Design Registry in Nigeria requires that the applicant complies with the requirements of the Trademark Act. The filing is done by an accredited agent who is a lawyer specialized in trademark field to provide legal advice and process the application.

The basic requirements and procedure for Filing of a Trademark application are:

  1. The applicant will provide the name, address and nationality of the applicant
  2. Power of attorney to file the application on behalf of the company
  3. A description of the class of goods or service to be registered will be required for filing
  4. A logo/device to represent the brand of goods or service will be required in a jpeg format for filing
  5. Where the mark is a non-English word, a translation of the words in English will be provided for filing.
  6. Upon submission of these documents, the Trademark Registrar issues a Formal Acknowledgment form of a receipt showing the official number and date of filing the application.
  7. Thereafter a search is conducted to find out if the proposed trademark is not similar to that of existing marks.
  8. If the registrar is satisfied with the distinctiveness of the mark and that there is no similar mark and has thoroughly examined the mark to access if it is eligible for registration, a notice of acceptance will be issued to the applicant
  9. The acceptance letter evidence that the trademark can be used in course of its purpose of registration; and thereafter the trademark is published in the Trademark Journal for any opposition to be raised 2 months from the date of publication.
  • Where no opposition or objection is raised within the given period, the Certificate of Registration will be applied for at the Registry.

However, every trademark applicant must hire the services of a trademark-accredited agent for any trademark registration.
